Relief as Court Ruling Favours Waititu in Ksh588M Graft Case





Suspended Kiambu Governor on Thursday, October 17, received a consolatory win after a Nairobi court ruled in his favour in the ongoing Ksh588 million graft case.

In August, 12 Kiambu MCAs had applied to be enjoined in the corruption case faced by Governor Ferdinand Waititu.

Through their lawyer Ndungu Gathinji, the ward representatives argued that they represented thousands of Kiambu residents who were victims of the alleged corrupt deeds of Waititu.

However, lawyers of the embattled governor opposed the application on the basis that the MCAs sought to politicise the court case.
Chief Magistrate Lawrence Mugambi of the anti-corruption court had directed the MCAs in August to file an application and also asked the accused persons to make formal responses.

On Thursday, October 17, the anti-corruption court made the decision that barred the 12 MCAs from being enjoined in Waititu's graft case.

Waititu was barred from accessing his office or conducting any official business as governor when justice Ngenye Macharia made his August 8 ruling.

Justice Ngenye described the county boss as "morally ill" and added that the governor would stay away from the office until his case is determined.

Waititu, his wife Susan Wangari and eight county officials are facing corruption charges over the irregular award of a tender worth Ksh588 million.

After Waititu was barred from office, his deputy James Nyoro took over as the new county boss till the graft case against his senior was determined.

However, Nyoro hit the wall in his governance of Kiambu county when he tried to reshuffle the cabinet. The High Court barred Nyoro from reshuffling the cabinet after Marion Njoroge, a Kiambu resident filed a petition against Nyoro's move.
