Lawyer Assa Nyakundi has moved out of his Muthaiga North Estate residence to rent an apartment in Kilimani pending his court hearings.
His move follows the decision by his wife and son to testify against him.
The city lawyer was prompted to move from his home following an application by the prosecution that questioned how he would continue staying with the family yet some of the witnesses in the case are his family members.
Nyakundi, through his lawyer Cliff Ombeta, told the court that he had made arrangements to move out and stay at Aden Valley apartments until the matter is determined.
Assa’s wife, Lydia, and his eldest son Noah have been listed by the state among the key witnesses in the case.
It is claimed that Noah, who was seen crying uncontrollably during his brother’s funeral at Lang’ata Cemetry, never visited his father while he was in the hospital.
Assa had been admitted in hospital for almost six weeks where he was being treated of blood pressure related ailments.
During an interview with the Nation last week, the lawyer divulged that the shooting of his son was a “catastrophic event” adding that the incident has divided his family.
Contrary to his initial statement, Nyakundi, appearing before Kiambu Principal Magistrate Terresia Nyangena, denied charges of manslaughter.
Magistrate Nyangena released the lawyer on a Ksh1 million bond with a surety of the same amount or an alternative cash bail of Ksh300,000.
He was also ordered not to go near his family pending the hearing and determination of the case.
The hearing was set to begin on June 20.
