Why Jacque Maribe and Joe Jowie Were Charged Afresh

Citizen TV anchor Jacque Maribe and her fiance Joseph 'Jowie' Irungu on Wednesday took plea afresh in the murder of business lady Monica Kimani.

The defence team stated that it had no objection to a proposal to amend the charge sheet to include other suspects not present before the court.

This comes days after another suspect, Jennings Orlando Odhiambo, a Recce Squad officer attached to the U.S. embassy, was arrested in connection with the murder case.

The court, however, declined to enjoin a lobby group, "Empowering Africa Through Media" in the matter, arguing it didn't disclose its interest in the case

“The NGO is a stranger in this matter, they have not applied to be enjoined in this matter and therefore we are objecting to them in participating in this trial for they are not for state or the accused persons,” Catherine Mwaniki for the prosecution stated.

Justice James Wakiaga responded stating that the NGO should file a formal application to tell the court its interest in the case.
"If you wish to participate in the matter, come up with a proper application. For now, the affidavit filed in court is expunged," the judge stated.

Last week, Justice James Wakiaga ordered that probation officers prepare and submit a pre-bail report before Wednesday’s hearing and cautioned the media against publishing unauthenticated stories about the case.

The order was given even as claims emerged there may have been a spy from the Directorate of Criminal Investigations (DCI) inside the Gigiri Police Station cell where Maribe had first been detained.

Maribe has dismissed the claims by DCI that she knowingly assisted the main suspect, Irungu, in a cover-up and her only offence was being in a love relationship with a person that the police are interested in over the murder.

Maribe and Jowie will remain in custody awaiting their bail ruling set for Tuesday, October 30.

The Prosecution led by Catherine Mwaniki opposed to the releasing of the two on bail or bond stating that they have been charged with a capital offence.
