A man who was charged with defiling his daughter was on Monday set free by a Mombasa court after the girl confessed to framing him for the offence.
Issuing the ruling, Mombasa Senior Resident Magistrate Edgar Kagoni found that the girl lied citing inconsistencies in her testimonies over the trial period which commenced in 2014.
“Although I did not record the complainant’s testimony, I am persuaded by the record that hers was not a truthful testimony. She contradicted herself multiple times on who actually defiled her and where the offence was committed," the magistrate stated.
Justice Kagoni made the ruling based on the failure of the girl to corroborate evidence in her testimonies and during cross-examination. The girl also confessed to taking orders from police officers who coerced her to frame her father.
In her earlier testimony, the complainant had testified that her father defiled her when her mother had been hospitalised.
The man later forced her to spend the night in a nearby mosque.
In a later statement, the minor stated that she had been raped by two unknown men in another house, who threatened her not to reveal the crime.
The matter was, however, reported at Makupa Police Station after the girl confided in her mother.
During the ruling on Monday, the judge noted that the police file was not presented to the court after testimonies from the victim, the mother and a doctor.
Neither did the police officers show up in court to testify.
