The Ethics and Anti-Corruption Commission (EACC), on November 19, filed a lawsuit against former President Daniel Arap Moi and his then minister Nicholas Biwott over four parcels of contested land in Eldoret.
According to court documents, EACC demanded that the land allocated to Lima Ltd, which is associated to the two, be declared public property and the allocation illegal.
The land, on which sits the Administration Police Camp and Eldoret Fire Station, was reportedly fraudulently allocated between the years of 1995 and 1998 to the company
“EACC has proved to the required standards that the suit properties were reserved for public utilities and are in actual use of public bodies,” read the lawsuit.
The affidavit further accused the 1995 board of survey for government offices of illegally allocating the land to Lima Ltd after they earmarked the then structures on the parcels for demolition.
The four parcels are located on; Uganda Road, Elgeyo Road, Oginga Oginga street and the connection between Uganda road and Zion Mall junction.
Prior to the allocation, the pieces of land had been set aside for District Commissioners office, the Administration Police camp and law courts.
As part of the affidavit, EACC further claimed that the allocation process totally disregarded public interest.
“If the buildings were old, why not repair or rebuild them?” posed EACC.
The then ownership records indicated that Mr Robert Wilson and President Moi owned the company while Mr Gideon Kipsiele Moi and Mr Biwott were listed as its directors.
