
Machakos Governor Alfred Mutua will not be prosecuted over the alleged fraudulent purchase of 16 motor vehicles for the county government.
The EACC and DPP reached a consent with the governor at the Appeals court.
The parties have also agreed to bear the individual cost of the case that had been filed at the Court of Appeal.
"This appeal be and is hereby marked as withdrawn in terms that EACC and DPP undertake not to institute any criminal charges against the appellant."
The consent was reached in relation to EACC inquiry file no EACC/FI/INQ.51/2014, being an inquiry into the allegation of irregular purchase of 15 Subaru Outback vehicles and a Toyota Landcruiser.
The EACC and DPP undertook not to institute any criminal charges against the governor as they were the subject of a criminal case in Machakos court.
All accused persons in the said case were acquitted. The consent was recorded before Roslyn Nambuye, Otieno Odek, and Asike Makhandia.
Mutua had moved to the Court of Appeal to challenge High Court decision that dismissed his petition to stop his prosecution for fraud.
