The decision by Magistrate Joseline Ong'ayo, to hand Kanara Maina a fine of Ksh 1,500 for engaging in sex at Uhuru Park has sparked a heated debate on social media platforms.
Maina was also given the option of a one-month jail term for his indecent exposure in the public park in broad daylight.
The accused pleaded for mercy and leniency by the court, but the magistrate was adamant that none would be granted.
Magistrate Ong'ayo went on to reveal that the act was classified as illegal in the county by-laws and issued a stern warning to the accused not to ever repeat it again.
However, netizens took social media and were quick to point out that the lady he was busted engaging intimately with, Joyce Wanjiku, was suspiciously nowhere to be seen during the sentencing.
"Where is the colleague coz he was not alone, I think both of them should face the jail term," Thomas Lekenya posted.
Reports by Capital News had stated that the lady had chosen to abscond court, but netizens were having none of it as they tore into the country's judicial system.
"I think two people should be charged here if it was not rape," Raphael Semelang'o posted on Facebook.
Other simply sided with the law and blamed Maina for failing to employ reason before he chose to engage in sex at a public park.
"An average room in the city streets would have cost roughly 3k. I find Uhuru Park rates payable thru the law courts quite fair," Wanjala Munyakho posted.
"Was he having sex with himself or with another person at the Uhuru park?" Oyugis posed on Twitter.
"The county government should have rooms for love birds just as it has washrooms all over town," George Kariuki remarked through facebook.
